Business Organization

At Smith & Wade, our attorneys take a consultative approach to business organization. We recognize that selecting the proper business entity model is essential to the long-term growth and financial health of the business and protection of its owners’ assets.

Our lawyers understand the importance of considering taxation, asset transfers,

Anyone will benefit from estate planning.  The planning process is beneficial even if estate planning documents are not utilized, or probate is avoided.

In addition to disposition of property at death, we offer comprehensive estate planning which addresses important issues such as: who will make financial and medical decisions in the event of incapacity or death and who will care for a client if the need arises.  We also emphasize the most important consideration for all parents with minor children -  how will my children be cared for if we both passed away before they were raised ? 

In our estate planning process, we discuss the pros and cons of probate wills, living trusts, testamentary trusts, powers of attorney, living wills and advance health care directives.  We prepare estate plans every day that range from the most simple to complex death tax minimizing plans.

Estate Administration

Often it is not necessary to open a probate estate upon the passing of a family member.  We work with the clients to make the process after death as streamlined as possible, allowing him or her to handle as much, or as little, of the work as he or she feels like undertaking.

To the extent needed, we can open a formal probate estate, administer a trust, administer life insurance benefits and retirement plans, transfer securities and other investments, resolve claims against the estate, prepare death tax returns and fiduciary income tax returns, transfer real estate and draft any affidavits needed to transfer property.
